Terms of Service

1. Acceptance of Terms

By accessing and using Catalyst Analytics' services, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Services Provided

Catalyst Analytics provides:

• Website design and development services
• Managed website hosting
• Ongoing website maintenance and support
• Performance optimization services

3. Service Agreements

Individual service agreements (SOWs) will outline specific deliverables, timelines, and payment terms. These SOWs supplement and are governed by these Terms of Service.

4. Payment Terms

Payment terms include:

• Payment schedule as defined in individual SOWs
• Late payments subject to 1.5% monthly interest
• All fees in USD unless otherwise specified
• Hosting fees billed monthly or annually as agreed
• Refund policies per SOW terms

5. Intellectual Property

Intellectual property rights are defined in individual service agreements. Unless otherwise specified, custom-developed website code becomes client property upon full payment, while Catalyst Analytics retains rights to pre-existing IP, tools, templates, and methodologies.

6. Confidentiality

Both parties agree to maintain confidentiality of proprietary information, trade secrets, and sensitive business data. NDAs may be executed for additional protection.

7. Hosting Service Level

For managed hosting services, we commit to 99.9% uptime. Scheduled maintenance will be communicated in advance. We are not responsible for downtime caused by third-party services, client modifications, or factors outside our control.

8. Performance Guarantee

We guarantee a minimum PageSpeed score of 90+ for all websites we build when launched. Performance may vary based on content updates, third-party integrations, or modifications made after delivery.

9. Warranties and Liability

Services are provided "as is" with the following limitations:

• We warrant professional services performed with industry standards
• Liability limited to fees paid for specific services
• No liability for indirect, consequential, or punitive damages
• Client responsible for content accuracy and legal compliance

10. Data Protection

We process data in accordance with our Privacy Policy and applicable data protection regulations including GDPR. Clients retain ownership of their data and website content.

11. Termination

Either party may terminate services with 30 days written notice. Early termination terms are specified in individual SOWs. Upon termination, client remains responsible for payment of services rendered. For hosting services, client will receive website files and data upon termination.

12. Changes to Terms

We reserve the right to modify these terms. Clients will be notified of significant changes. Continued use of services constitutes acceptance of modified terms.

13. Governing Law

These terms are governed by the laws of [Jurisdiction]. Disputes will be resolved through binding arbitration or in courts of [Jurisdiction].
